Pernikahan Beda Agama Menurut Fiqih Islam dan Pandangan Agama-agama di Indonesia

The phenomenon of interfaith marriage in Indonesia continues to be a complex issue within a multicultural society context. This research examines Islamic jurisprudence perspectives and the views of five officially recognized religions in Indonesia regarding cross-faith marriage practices. Employing a qualitative approach with library research methods, this study analyzes primary sources including fiqh books, clerical fatwas, and official religious documents, as well as secondary sources from academic journals published between 2021-2025. Findings reveal that the majority of scholars from the four main schools of Islamic law prohibit interfaith marriage, adhering to the principle of sadd al-żarī'ah to preserve the purity of faith. The Indonesian Ulema Council explicitly forbids this practice, including marriage with Ahl al-Kitab. Perspectives from Christianity, Catholicism, Hinduism, Buddhism, and Confucianism also demonstrate similar tendencies with varying degrees of restriction. Law Number 1 of 1974 and the Compilation of Islamic Law affirm the invalidity of interfaith marriages, although legal loopholes exist through court determinations. The dualism between religious norms and individual freedom creates tensions requiring contextual and inclusive approaches. This research contributes comprehensive understanding regarding interfaith marriage dynamics from various religious perspectives to maintain social harmony and legal certainty in Indonesia.
